فلسفة القانون عند کارل أوليفکرونا

تناول البحث عدة مشکلات قانونية فلسفيًا من منظور "کارل أوليفکرونا" فيلسوف القانون السويدي، کان أهمها مشکلة جدلية العلاقة بين الحقيقة القانونية والحقيقة الواقعية، وهل للقاضي أن يحکم بما رآه بعينه أو بما لديه من أوراق؟ وقد عرضنا للتعريف بـ"کارل أوليفکرونا" وأهم مؤلفاته والمؤثرات الفکرية التي تشکل من خلالها الأساس الفلسفي القانوني عنده، وظروف عصره خاصة القانونية، وأهم النظريات المفسِّرة للقانون، وبأية نظرية يؤمن "أوليفکرونا" وأدلته في ذلک. ثم أوضحنا موقفه من القانون کقوة مُلزِّمة، وقصده من القانون کقوة مُنظِّمة، والضرورات المستقلة ووظائفها، والجانب السيکولوجي للقانون وعلاقته باللغة والأخلاق والمجتمع. ومن أهم النتائج التي توصلت إليها الدراسة إيمان "أوليفکرونا" بعدم قُدسية النص القانوني وعدم احتکاره من سلطة عليا خاصة القضاء، وأن اللغة تلعب دورها في فرض قوة السلطة وإکراهها على المواطنين.
Abstract :
The research dealt with several legal problems philosophically from the perspective of "Karl Olivecrona" a Swedish philosopher of law, the most important was the problem of dialectical relationship between legal reality and reality, does the judge judge papers or reality? The research presented " Karl Olivecrona " and his most important works and intellectual influences through which he formed his legal philosophical basis, and the circumstances of his time, especially the legal ones and the most important theories explaining the law, and any theory Olivecrona believes in and his evidences. Then the researcher explained his position on the law as a binding force, his intention of the law as an organized force, the independent necessities and their functions, the psychological aspect of the law and its relationship to language, ethics, and society. One of the most important results of the study is that Olivecrona believes that the legal text is not sacred and that it is not monopolized by a supreme authority, especially the judiciary, and that language plays its role in imposing the power of authority and its coercion on citizens.
